And now we have to be like, please John Roberts don't retire because then they'll get their fifth vote. to end birthright citizenship for being in the Constitution So I could just talk about that. Yeah, so that's what's up first folks. That's pererfect transition. No notes So it's like we got six to three or five to four or eight to one if you want to be an optimist. But at any rate, the court ruled six to three that Trump's executive order Getting rid of birthright citizenship is unconstitutional, obviously, because it says it in the fourteenth Amendment. It just says it So it was six to three, but the actual five to four thing is that Kavanaugh was like, actually, I'm not saying this executive order should be struck down because it's unconstitutional. It should be struck down because there's a federal law against it, but it's actually up to the Supreme Court to determine what subject to the jurisdiction thereof means in the fourourteenth Amendment, and it's been interpreted different ways in the Wang Kimark case. So we could interpret it to add all of these exceptions, and then Congress could change the law. In reality, he's a vote that that's not what it says in the Constitution. R Basically Um And when I joked about eight to one optimistically, if you look at Gorsit's Dcent He's like, lookook, I wouldn't have thrown this executive order out entirely because there's a part of it that makes sense and he thinks if you're the child of a temporary visitor or something like that, then you should not get citizenship from being born here, but he does believe and he basically writes this out in his dissent that like, well, yeah, if you're the child of someone who lives here, if this is your domicile, whether you have legal status or not then yeah, you should then then you should be a citizen of the United States. And even Clarence Thomas kind of hints at this in his dissent, but he's very angry and all over the place. So there does seem to be some enagling here to be like, let me say what I would do, but not get the big guy mad at me. Yeah It's the vote in, but also like, but actually ye here's my little debate like paragraph to explain like reallyally what here's what's going on. And that is not to make anyone feel better. The headline here is that four of the nine Scotis justices I do not think the fourteenth Amendment says what it clearly says, and we can even say And that alone should be so fucking shocking to people. But it's I mean, it shouldn't be shocking know that that's what they want to do. But if if you If we put this in the context of a conversation about America, Hey, it's the week of the fourourth of July week. It's so fucked up. Polito leaked, a draft majority opinion written by Justice Samuel Alito, revealing that the U. S. Supreme Court had privately voted to strike down Roe v Wade. and overturn constitutional abortion rights It's just like this was not a thing until veryery recently, their push to make birthright citizenship, the next thing on their list since they're like, oh shit, we had some successes here and we spent decades and decades. what's next? And now their thing is upending the way citizenship works and I guess trying to bble together some kind of makeshift citizenship rules, I don't know how you would do it otherwise or what their proposition is, they don't care. It' right? It's not like it's not like the people they don't like wouldn't here and or they'd be easier to deport, I guess, but they just want to deport. You're just deporting how ten times as many babies. Is that the plan? Yes, that is what they want. I mean it's all stems from Stephen Miller like even talking about it, right? Like he's he's like the one leading the charge rhetorically about this And then everyone' sort of caught on' like, oh I guess we're going to be bad about this And with this decision, now they're all just sort of talking about like, what can we do? Well, get rid of these people, get rid of these people, do this, do this, do this. and then the birthright citizenship won't matter because there'll be nobody here Um so it's they're just going to use this as an excuse to crack down even more Yeah. and you know, the problem is now that they've seen how close they are. I don't know if they knew that they would have four votes this way. And so now there's going to be like tremendous, I think there's tremendous pressure on the Democrat side to like figure something out. we have to be like strategic if there's a democratic president in twenty twenty nine, Sotomayor and Kagan cannot wait anymore and you know they have to strategically retire to be replaced. and then that something that they've got a few more spots so that because if Robertss goes away, you know, youre John Roberts stroke away right now from birthright citizenship being gone and these other weirdos trying to piece together their rules for it. Yeah. Trump for his part, seemes to think that there is now like something Congress can do Lgislative solution to this That is what they're going to try to do for sure. I've se so many people today being like Why is everyone like you're celebrating this about trans athletes. But like This is the proble like they're pointing to birthright citizenship is like this is what is what we cared about the most. We don't care about this anymore. Except what have they've been talking about for the last ten years exclusively. They're very upset that anyone is being like, oh, we got we got this and it'sorry sorry about birthhip. There's very very confused about what they're supposed to care about and what they think are like the real the real problems in America. Well, I can go through that O Re bummer, very expected, but doesn't make it any easier to see. Yeah. So the court allowed state bans on trans women and girls from competing in sports to stand in Idaho and West Virginia. It was I'm so sorry inger jag It's literally, no, no, not at all. It's specifically trans women and girls Doesn't go both way. Yeah, well, because this is all about a competitive advantage and fairness, you see. So I don't think they'd be happy about the inverse happening. But no, this is specifically about trans women and girls competing in women and girls sports in those two states, but I think there's a couple of other dozen states that have similar laws like this. So You know, this one was especially disappointing because it was six to three the usual makeup that it doesn't violate the equal prrotection cllause, but it was nine to nothing that the bans don't violate Title nine because of some language the language of sex being used versus the language of gender, that kind of thing. So Kavanaugh in his ruling says that the court should interpret the original meanings of the equal Protection Clause to not discriminate based on sex, which has the same meaning he says as it did in the nineteen seventies. And he argues that you have to take into account safety and competitive fairness in rendering judgment of the laws. And sootomayor picked up on this and points out that the plaintiff in the West Virginia case underwent gender affirming treatment and never experienced male puberty, which would seem to shut down the argument that she would have had a competitive advantage over cisgender girls. We've talked a lot in the past about the studies showing that many trans women don't have competitive advantages for various reasons, HRT and this kind of thing. So U just actually mean to people. That's that's that's what it is. They don't like trans people and want to hurt them U But again, specifically trans women. go right. I only point that out because they don't seem to care very much. about trans men, if at all, you know I mean, as I Greay points out, trans guys used to being erased. Yeah, I think they I say they don't like anyone U I was about to say they don't like any trans people. They don't like anyone really. They these guys really hate people And so they want to find ways to take the most vulnerable among us and batter them down even more. You know, and it's like right like they did this to it's like a it's like a election wedge issue. It was always political theater If you drill down into it, they're talking about some conception, this idea that they have, that they've been given from their little media ecosystem. They've never met a trans person or if they did. They didn't know They didn't know because it's just An woman, it's another man. and they've been told to care and they spent so much time pretending to care You just have to see it through. but reminder that this affects such a small percentage of people this was so unnecessary, such an unnecessary holabaloo. Yeah, they get like a culture war victory, I guess, but that's it.s like culture real people's lives that they're playing with. And also this will affect as we say over and over, this affects everyone as will affect isgender girls as well as well because Thank you for that having their pants inspected and by who like who I mean, that's part of it too They hate women. so they want to have more control over women in any way possible. It's another way to try and insult a woman, to try and bring her down a peg of some capacity. You see it happen all the time now you know with athletes that maybe doesn't traditionally look a certain way, fit into a certain box, you know, screaming about, have they done DNA testing, like check their hormones. It's so nasty And yeah, it does have implications. The very few people are specifically affected by this law, but a lot of people are affected by the conversation around around trans people in general. the last point I wanted to make was they get this win and they don't care about it They don't actually care about the wind. They're so incensed. by this birthright citizenship ruling. and that should say it all, man, that should just show exactly how much they ha. They're mad' pointing us out as like a win They' like But that's just you've just Matt you made a whole fucking movie trying to make fun of trans women But you don't care. Okay, goodood to know. goodood to know you don't actually care. That's the right attitude. I mean, it's like it's one of those things where, you know, they get their little fixations and then you hope it's just a fixation. Excuse me. You know, you hope it's a fixation so that they'll move on to something else and that they won't keep like badgering the same vulnerable group of people over and over again for decades. And it's just like trans people are being put through the ringer for you know forever, But like in particular in the last decade with the Trump administrations and the culture war like fixating on them, like obsessively. like it's weird how much they fixated upon them in the run up to the twenty twenty four election. I guess it's like a clever little thing, but I actually don't think the Kamala is not for you. She's for they them ad was all that impactful. Right? Like I think it's just kind of like Oh, look at that. They're like the libs hate this. I think that's what it's about. and I don't think anyone who on the fence is swaying. like that. No, they're not They're not. It just is I talk to plenty of people. You know, everyone loves it when I talk about it, but they'll care about it in the con in the confines of a general conversation, but that's not what's making anybody vote one way or another. Oh yeah, more more of that something. Then there's that So this was another six to three that Kavanaugh got to write as well or someone on his team, I don't know. But they struck down this law from after Watergate that limited how much money political parties can spend on behalf of candidates saying it violates the First Amendment. And now there's really no limit to how much the parties can spend. So even though they're still like a limit to how much you can donate to a candidate or to a presidential candidate. There's no limit to how much the party can spend. So you can max you can do a max seven thousand dollars donation to the Trump twenty twenty four campaign, but then or I guess the Trump twenty twenty eight campaign or advanced twenty twenty eight campaign or whatever it ends up being, but then do a whatever donation to the RNC and then they can distribute that money and really goose things for their candidate. This is going to help Republicans because billionaires like them more. They do. So Elon can just give as much money as he wants to and see So bad for our country Like, yeah, sure helps Republicans I mean, not yah, sure. it does. or incentivizes the Democrats to become even more in the pocket of big industries than they already are. It's just is one more nail in the coffin of what I can see that are reed Like the democracy a healthy democracy. like the inherent principles. And so it's like just one of these moments where like a natural disaster hits and then you wish we weren't in a position of having made situations around the world so much worse we talked about it how we didn't know how US aid responses might have helped in this effort. I also think the situation was much different, I think back in the Haiti earthquake in twenty ten I think that disaster broke records in terms of fundraising and donations to NGOs and then There were certain NGOs that had scandals about misappropriating those funds. and I feel like people are so overwhelmed right now that it's a lot harder to be like, we all have to come together to like help this thing. And but this is just one of those like so overwhelmingly bleak things that I hope people don't lose their sense of humanity given Yeah Right. I agree with you completely. I will add to it that. Some of this online fundraising seemed very novel at a point in time But right now, it's relied upon For every emergency, every health crisis, you know, we all know people that have started fund me or different sorts of fundraisers to help them through their own personal crises. and it's just sound fundamentally broken that we can't rely on our government to help in any sort of a real way. and we need to rely on the kindness of strangers to get us through. And there's something beautiful about the fact that so many people are are open hearted and want help and I'll bring it back to America again.
