Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the Podtastic website, applications, and services (collectively, the "Service") provided by Podtastic ("Podtastic", "we", "us", or "our"). By creating an account, using the Service, or clicking to accept these Terms, you agree to be bound by them.

If you do not agree to these Terms, do not use the Service.

Summary of key points

  • We provide a podcast player with AI-powered features. AI results are not guaranteed to be accurate or complete.
  • We collect only the data needed to run the Service. We do not sell your personal data.
  • Subscriptions renew automatically unless you cancel. You can cancel anytime.

1. Eligibility and Accounts

  • You must be at least 16 years old to use the Service. If you are under 18, you must have parental or guardian consent where required by law.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • Provide accurate information and keep it up to date. We may suspend or terminate accounts that are inaccurate, fraudulent, or unauthorized.
  • You may delete your account at any time via settings where available or by contacting support@podtastic.app. Deleting your account is permanent and will remove your profile and associated personal data subject to our retention obligations.

2. Subscriptions, Trials, and Billing

Subscription Tiers

The Service offers the following subscription tiers:

  • Free: Up to 2 podcast feeds, all Pod-telligence features enabled on those feeds.
  • Starter: Up to 6 podcast feeds, $3.99/month or $39.99/year.
  • Unlimited: Unlimited podcast feeds, $9.99/month or $99.99/year.

All Pod-telligence features (Smart Summaries, Smart Topics, Smart Playback) are included at every tier. The only difference between tiers is the number of podcast feeds you can subscribe to.

Auto-Renewal and Payment

  • Paid subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before the renewal date.
  • For annual subscriptions, we will send a reminder before your renewal date as required by applicable law.

iOS App Store Purchases

If you subscribe through the Apple App Store, payment will be charged to your Apple ID account at confirmation of purchase. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in Settings > [Your Name] > Subscriptions on your iOS device. Apple's terms and refund policies apply to App Store purchases. Google Play Store Purchases

If you subscribe through the Google Play Store, payment will be charged to your Google account at confirmation of purchase. Your subscription will automatically renew unless cancelled before the end of the current period. You can manage and cancel subscriptions in the Google Play Store app > Payments & subscriptions > Subscriptions. Google Play's terms and refund policies apply. Cancellation and Refunds

  • You may cancel at any time using the same platform where you purchased your subscription (Apple Settings or Google Play Store).
  • Upon cancellation, your access continues until the end of the current billing period. We do not provide refunds or credits for partial billing periods except where required by law.

Trials and Promotions

  • Free trials and promotional offers are subject to change or discontinuation at any time. If you do not cancel before a trial ends, you will be charged for the next period at the then-current price.

Price Changes

  • We may change prices upon advance notice as required by law. If you do not agree to the new price, cancel before the change takes effect.

Feed Limits and Downgrades

  • If your subscription expires or you downgrade to a tier with a lower feed limit, your existing podcast feeds remain accessible but you will not be able to add new feeds until you are within your tier's limit or upgrade.

Platform-Specific Subscriptions

  • Subscriptions purchased on iOS apply only to iOS. Subscriptions purchased on Android apply only to Android. A subscription on one platform does not grant access on the other.

3. Permitted Use and Restrictions

  • You may use the Service only for lawful purposes and in accordance with these Terms.
  • License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. You may not rent, lease, lend, sell, redistribute, or sublicense the Service or any content obtained through it.
  • You agree not to: (a) reverse engineer, decompile, or attempt to access source code except as permitted by law; (b) bypass or circumvent any access or usage limits; (c) use the Service to infringe the rights of others; (d) upload malicious code; (e) use the Service to train competing models or datasets without our prior written consent; or (f) systematically extract or redistribute podcast content processed by the Service.

4. User Content and License

  • You retain ownership of content you submit to or through the Service ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content solely as necessary to provide and improve the Service.
  • You represent and warrant that you have all rights necessary to submit the User Content and that it does not violate any laws or third-party rights.

5. Feedback

  • If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback without any obligation to you.

6. Third-Party Services

  • The Service may depend on, integrate with, or link to third-party services (e.g., podcast hosting providers, app stores, cloud infrastructure, or analytics platforms). Your use of those services may be subject to separate terms and privacy policies.
  • We are not responsible for third-party services and do not endorse them.

7. AI-Generated Features and Content

  • The Service uses AI to generate features such as summaries, topic markers, and content analysis. AI-generated content is provided for convenience and may contain inaccuracies. It should not be relied upon as authoritative.
  • We may modify or change AI features at any time. We do not guarantee the continued availability or accuracy of any specific AI feature.

8. Advertising and Analytics

  • We use analytics and advertising tools to understand usage and grow our business. Details are described in our Privacy Policy.
  • You can opt out of targeted advertising as described in our Privacy Policy.

  • Your privacy matters. Our collection and use of personal data is described in our Privacy Policy. Please review it carefully.

10. Intellectual Property

  • The Service, including all software, features, designs, and content, is owned by Podtastic or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights.
  • You may not use our names, logos, or trademarks without our prior written permission.

11. Termination

  • You may stop using the Service at any time and may delete your account as described above.
  • We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, pose a risk to the Service or other users, or to comply with law.
  • Upon termination, sections that by their nature should survive (e.g., feedback, IP rights, warranty disclaimers, limitations of liability, indemnity) will survive.

12. Disclaimers

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
  • Some jurisdictions do not allow the disclaimer of certain warranties; to the extent required by law, those warranties are limited to the minimum period permitted.

13. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODTASTIC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

14. Indemnification

  • You agree to defend, indemnify, and hold harmless Podtastic and its affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

15. Export and Sanctions

  • You may not use or access the Service if you are located in a country or are on a list that would prohibit such use under applicable export control or sanctions laws. You agree to comply with all such laws.

16. Governing Law; Venue

  • These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by the laws of England and Wales.
  • The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in the UK or EEA you may also bring proceedings in your country of residence as required by mandatory law.

17. Changes to the Service and Terms

  • We may modify the Service, introduce new features, or discontinue features from time to time.
  • We may update these Terms to reflect operational or legal changes. If we make material changes, we will provide notice (e.g., by email or in-product). Continued use after the effective date constitutes acceptance of the updated Terms.

Entire Agreement

  • These Terms, together with any policies referenced herein (including our Privacy Policy), constitute the entire agreement between you and us regarding the Service.

Severability

  • If any provision is found unenforceable, the remaining provisions will remain in full force.

Assignment

  • You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.

Waiver

  • Our failure to enforce a provision is not a waiver of our right to do so later.

Force Majeure

  • We will not be liable for delays or failures due to events beyond our reasonable control.
