On the Dcket todayod, we have some various divorces across franchises Some of these we have spoken about before, so these will be updates Others of these are newer and we have not covered them yet. So we will be covering Drew and Ralph, Kim and Croy Diten PK And candy.'s a lot. I don't even feel like saying the other gu's name I already forgot it. Todd, Todd, Candy and Todd. Bye, Todd. Be There's a lot going on in these. a ton As is the norm in any divorce, but it seems like real housewives' divorces are particularly contentious. So a lot of filings going on in most of these There's several filings, and probably all of them that are sealed, but there's still a lot of information that we have. Some more information than I would want, actually. None of the ones I looked at were sealed. Oh, I guess the one I did was Kim and Croy, and there was a bunch of stuff that was randomly sealed in there. Including Kim's deposition, which I really wanted to read 'cause when she was involved with another guy that we'll talk about. Yeah, we'll get there So interesting fact when this comes out, it will be The week of my tenure reunion. Oh wow. I know. It's been ten years, which is crazy. So I will be up in New York and then up in Ithaca, which I'm excited. That's exciting. Yeah, it's cool. I ha't been there since twenty nineteen. veryery excited to go back to Cornell All right, so let's start with Ralph and Drew. We have previous episodes on them where we go into more detail. Drew Sedora is an actress, singer, dancer. She was, I think, most famously in the movie Step Up. She was on The Real Housewise of Atlanta and then her she still is. Yeah, she still is. Okay. Her husband, Ralph is on there as well. I never liked Ralph. I've been very open about that, but that does not mean that I think Drew is perfect either D don't want to know what happened in Tampa, Ralph Both of them filed competing petitions on february twenty seventh, twenty twenty three, and we talked about those in a prior episode. We went through them We went over the statements that they gave to the media about their divorce. We talked about how Ralph was living in the basement of the marital home. We saw it on Real Housewivess Event Lyena. She would leave the home when he was allowed to emerge from the basement as a recap He filed on the grounds that the marriage was irretrievably broken with no reasonable hope of reconciliation Do you want to read what he was requesting Okay, so Ralph wanted joint physical custody with a parenting schedule that results in equal time for both parties and joint legal custody. He asked to retain final decision making authority for academics and medical careare slash health insurance. for their two minor children. I mean, that started out really reasonable, but That's a lot. to say like, oh, I get the final say for school and medical care and health insurance He requested sole ownership and exclusive use and possession of the Merriill residence, claiming that he, Ralph, solely satisfied the loan and maintenance costs. He requested equitable division of a joint debt from a personal loan used for joint ventures. That's pretty vague. He asked that individual credit card and tax debts remain the responsibility of the party in whose name they are held My commentary there, that's typically pretty fair unless one person was running up someone else's credit card that they had access to He requests that Drew be denied any temporary or permanent alimony slash spousal support. and he requested that Drew refinance the twenty twenty one Cadillac Escalade in her name and indemnify him against liability. while he keeps the twenty twenty two Porsia Not Cyanne, but Ten I can I don't know. at the twenty twenty two Portchiae and the twenty eighteen Cadillac XT five and that he would indemnify her if there's issues with those vehicles. And then Drew, like I said, filed her own complaint or her own petition for divorce. And we noted this in our prior episode, but unlike many other cases that we talked about where it's just irreoncilable differences, her petition explicitly stated that the reason was adultery, which is one of the reasons that you can get divorced in Georgia. She alleges that Ralph is a serial cheater and adulterer who participated in extramarital sexual relations For custody, she requested sole legal and physical custody of the children with Ralph ordered to pay child support, and then she wanted to retain sole possession of the marital home So Drew actually fought to keep the filings in this case sealed, and most were for a while. When we last reported, everything was mainly sealed except for Ralph's motion for sanctions And that had several key filings attached to it as exhibits. that was filed april twenty twenty five. And that was how we were able to report on the divorce Now everything has been unsealed and we'll talk about that a little bit later. just as a reminder of what the motion for sanctions was, and this is one of many, but this is the one that we covered in our last episode. He was arguing that both against Drew, who is identified as petitioner, he's respondent, against Drew and her attorney that they had both engaged in some misconduct. and he at various turns has tried to get her attorney disqualified So he was arguing, I don't know if you remember this, but that Drew and her counsel disobeyed the mutual restraining order that was in place for their finances. by disposing of their co owned business, Drusidora LLC, He alleged that they filed false documents with the Georgia Secretary of State to withdraw its authority to do business while it was still active. There were also some successor companies where he says that they were basically diverting assets from him that should have been community property.. Some unauthorized financial encumbrances. So he argued that Drew had unilaterally executed high risk commercial financing agreements in the name of Drusidora, LLC pledging the marital home as collateral, which would obviously affect him given that they were still and still are trying to figure out how to separate their assets. Do you remember this? I don't for some reason. but I also think I dislike Ralph so much generally that I'd kind of just block him out of my brain. Yeah I remember there was something with housewives too I think Drew Sedora LLC was the entity that would sign the agreements for the realal Housewives whichich made it a big deal to get rid of it. So that must have been her loanout company M. Okay. He also said that the attorney violated the Geora rules of professional conduct. representing both Petitioner, so Drew and the parties's co owned business without a conflict of interest waiver. So Like I said, he was really trying to get this attorney out. The attorney is still representing Drew. so tellells you how that came out Drew basically denied everything. Yeah. If you want to hear more about this filing, go listen to our last episode on this I did want to touch on what happened in seeason sixteen about the ceiling. So I remember you and I I think previously discussing how we were surprised that Drew wanted this sealed so badly given that Ralph, in our opinion, had a lot more to answer for. So she shared with the audience that the court eventually did order to unseal the filings, which is how we now have access to literally every filing The judge's ruling, she said was to unseal our divorce case. Ralph did not turn over all of his financial documents and he still gets to live in the basement Is this a joke? She said in a confessional. She said, I don't know why Ralph wanted to inceal the case. It's like a nightmare As Drew reasoned in the confessional, quote, I just don't want the kids to have to read all about all of Mommy and Daddy's fighting. After the judge handed down the decision to unseal her and Ralph's divorce records, Drew added that now their children will have to see everything on the internet and that is my biggest fear A producer asked in the talalking Heads, what in the divorce documents is so damaging, and Drew replied, There's definitely more evidence against Ralph than against me. When asked if there are any scary details that she might be ashamed of that could come out, she claimed there's no scary details for me I'm more fearful for rout Ralph also gave a statement. Do you want to read what he said? Ralph celebrated his legal win and explained his position to his cousin, Dwight This is when he was on the show still.Qote, We got to unseal the records because we need transparency with everything going on. He said claiming that he Ralph pays for the house and that Drew wanted to get him kicked out. I don't want the world knowing about what we got going on, he added, But unfortunately, this is what we got to do. In a confessional, Ralph elaborated, quote, I've made mistakes through the course of our marriage, but Drew has too, you know? And so I believe the unsealing of the records gives us one hundred percent equal playing field He added, There's a lot of misconceptions about me and Drew. And I think the biggest is that I didn't care for my wife I mean, two things can be true at once. Drew can be doing things that are wrong and Ralph can still be a terrible human being the same time Right. So a lot has happened on the docket. Like I said, a lot of it is not worth covering. What was the most recent Lisa Hawkstein? Oh yeah, Lisa. Yeahes, so it's very similar to Lisa's divorce from Lenny where it's just tons of filings back and forth, both are accusing each other of violating different orders Both are trying to get the other sanctioned or held in contempt And it's just a lot of back and forth that is not worth getting into. Because as far as I could see, no one was held in contempt, no one was sanctioned The court was like, no I'm not ordering this So it didn't really go anywhere. The thing is when that happens, the courts see that and they see it all the time when divorce or family disputes get contentious. And I think it just kind of becomes noise to the court after a certain point because they're so used to people behaving poorly in those circumstances. because You feel like you're fighting for your life and your family and then it brings out the worst and even the most reasonable level headed people. The only people that win in that circumstance are the lawyers. Right. So there was a lot of motions as well to continue the trial. So the trial date kept getting pushed There was eventually a final trial, march tenth, twenty twenty six, but I believe that was just for custody because there are still tons of filings on the docket concerning financials. So they both moved for each other's financial records, and the court granted this on march eleventh, twenty twenty six. I thought this one was worth reading from because it's about housewives. As the court is charged with determining pending financial issues, the court finds good cause for the production of contractual employment and compensation records relevant to each of the parties Can just make a note here in a divorce proceeding where you are having a division of assets and determining whether someone's going to pay spousal support or custody That's standard discovery. Completely. Yeah, there shouldn't be a fight over it. Yeah ninety one percent of dog parents say their pup is an important member of their family. OkayK, well, I could see that if maybe NBC, they subpened NBC directly and NBC was like, I'm not doing it without a court order But also, Drew and Ralph should be in possession of those records so they shouldn't have had to subpoena NBC Right. but okay Records to be produced. The contract and compensation records to be produced shall be for the time period january first, twenty twenty three to date, including Seasons thirteen through seasons seventeen of The Real Housewways of Atlanta, including all related filming, such as reunions, andcillary filming, Watch What happappens Live, promotional Aearances benefits and all compensation paid to A, Drew Pitman, and B, Ralph Pittman spepecific records to be produced for each party shall be all fully executed employment agreements, talent agreements, appearance agreements, and independent contractor agreements, all fully executed amendments, modifications, writers, addenda, and side letters to any such agreements, all forms, ten, ninety nine W twos and other tax reporting documents issued to the parties payment records season in the form of payroll summaries, pay reports or statements. Oh, and then we have one here. Oh, well, this is separate. So this is the checklist, the child support worksheet that they had to submit. and you know, we like going through financials. so I wanted to put it in here. So this is something the court will review for determining how much should be paid, if anything at all, for child support. I love it when we split up the research because then I get excited So I haven't seen it. I'm like, o, monthly gross income Drew Pittman, twelve thousand sixty six dollars ninety cents. Ralph Pittman seventy one thousand five hundred and twenty four dollars fifteen cents. Wow. He's making a lot of money. What is he doing to make all that money? He's actually very accomplished. I remember when this came out and I was reading on Reddit. peopleeople like, wait, what does he do So he is a global client director at Gartner. It's a global research and advisory firm From what the Reddit was saying, it's a really place It's impressive, I guess that he's working there. People said I didn't even know Ralph had to job let alone an impressive one. People like when I saw his profile, I was shocked Drew really made it sound like he was an unemployed bum. Someone said, Wow, that's a huge firm. I recently graduated business school and Gartner was one of those companies everyone wanted to intern for. Wow, Gartner is a big firm actually. Everyone's just surprised he's not a bum. And then questioning Drew's income. given that she has movie roles and stuff, but it's easy for money to go out. Gartner produces extensive reports, market forecasts, and industry trends. They're well known for proprietary visual frameworks like, and then there's a link here to American Eagle Okay, so that apparently is what Ralph does to make all of that money. I still don't really know what it means, but still don't like Ralph, but whatever pro ratest shares of combined income Drew thirteen point two nine Ralph eighty six point seven one. ' making all that money. Why is Drew showing up to secret Santa parties with old hair and not an actual gift like everyone else I bet you well, yeah She probably getting any of it. That's what I'm saying. obviously wasn't sharing this with her when they were married. If she only has thirteen point two nine percent, I'd like the magic quQuadrant to look at this determination 'causeuse this doesn't make sense. If she presumptive amount of child support, so Drew makes way less than Ralph, but they're saying the presumptive amount for child support she would have to pay is six hundred and seventy four dollars thirty eight cents. and then Ralph one thousand seven hundred nine dollars eighty four cents. It seems like that's, I don't know, I guess it's more than double, So shortly after the hearing or the trial on custody, There was a court order on april second, twenty twenty six And this is a big one that most people were reporting on And we'll just go through it. So it says the evidence admitted so far at the final trial, which commenced on march tenth, twenty twenty six, includes that in the spring term of twenty twenty four during which time Drew was awarded primary physical custody, the public school for the children reported twenty nine tardies for one child and thirty three tardies for the other child. We'll call them M and A. In the school year, ending may twenty first, twenty twenty five, during which time Drew has primary physical custody. The school reports thirty one parties for M twenty eight tarties for A. On january twentyenteth, twenty twenty six, the elementary school sent an email to Drew and Ralph expressing concern that both children have missed seven days of school this year During which time, Deru continues to have primary physical custody. Then june twentyeth, twenty twenty five psychiatric professionals so this was a year prior sent a discharge letter ending treatment for M due to repeated difficulties with attendance A warning letter was sent on may ninth, twenty twenty five And this was again when Drew had primary physical custody. Then on november twelfth, a separate mental health provider emailed the parents again and said, shouldhould you have one more missed appointment or late cancellation within a twelve month period You may be dismissed from our practice. Ek Yeah So the final order, given all of the evidence presented is on page four of this document. if you want to open it up. Oh wait, presented to the court at the final trial showing an income for petitioner So it's Drew of twelve thousand, but then respond at twenty seven thousandars. So that not the eighty something at the final trial It's still more than double what she's making. But what I submitted or what we were reading from was after the trial. That was after the trial? Okay It says each parent shall contact the children's current or most recent counselor within seven days of the date of this order to schedule an appointment separately or together to discuss how to best address their impending divorce with their children. It is noted that provision from the order remains in place that neither party shall discuss the court case or any litigation with the children. Wow. So there must have been big issues with that for them to order that. wow Mm than the marital home. So Drew was ordered to vacate the marital home no later than may thirty first, twenty twenty six. Having considered the current financial circumstances of the parties orders that beginning on april first, twenty twenty six until such time as Drew vacates the marital home The party shall evenly divide the costs associated with the marital home Each party shall continue to pay all other costs they have each been paying otherwise. So they ordered Drew to leave the home because she's the petitioner.. Okay. And she still has to pay half the cost of the home, even though Ralph makes more than double what she makes.. Okay. Wow. Petitioner and respondent share joint legal custody of the children. After consulting with each other about matters involving the children responded so Ralph Sheall have final decision making authority over all decisions except that Drew shall have final decision making authority over the extracurricular activities of A Pitman. If Drew chooses to vacate the marital home prior to school recessing for the summer, the children shall remain in the marital home until the end of the school year with Ralph so long as Ralph continues to live there. Until the end of this school year, Ralph shall deliver the children to school in a timely manner and Ralph shall be allowed upstairs in the marital home to prepare the children for school. Beginning Friday after school recesses for the summer The parties shall rotate parenting time with the children on a two week basis. Okay And then holidays should be divided evenly and alternated Here's the thing, I don't know what all's going on here, but if Ralph is fully giving his lawyer everything that that lawyer needs and also not creating the issues where the children are showing up late, Yeah. it goes a long way. Yeah, an attorney can only be as effective as sometimes as the information they're getting from their client and the cooperation from their client, particularly in these types of situations where You have to I mean, she must not have had an explanation why those kids relate M or absent I mean, she has one now because she moved for reconsideration. So she put some explanations now, but it's too late, right? So she moved for reconsideration. She included a lot of exhibits But her main arguments were that she believes she was denied a meaningful opportunity to be heard because she says the order was entered in the middle of trial that was halted due to a medical emergency, preventing her from presenting rebuttal evidence or testimony regarding custody and financial issues I didn't know that because there's no hearing transcripts or no trial transcripts, but that's interesting. Yeah. The petitioner argues that the order relied on incomplete facts and false testimony provided by Ralph. Specifically, she claims that the attendance and tardiness issues were caused by documented medical conditions and appointments, but not neglect. She says that respondent misrepresented his income by approximately forty thousand dollars per month on his financial affidavit. I don't know how that helps her though. Well, that makes sense though, because why does this order say twenty something? and then the other order says seventy something? And so you said the one that said seventy something was after the twenty something one. So if the court did find that one, then he did misrepresent that. So the one where it said, o he twenty seven thousand that he misrepresented his income because it was way more than that. And then when we were talking about how much money he made and we looked up whatever magic quadrant and stuff, it was because he was making seventy something order where he was making seventy something was after the one that said twenty. Oh, okay, sorry. I was thinking of it reverse. Yeah. So he must have been, if the court found that and put that in the order, then he must have misrepresented how much he was making. Right. She claims that there was evidence regarding miss theraapy appointments that were due to inaccurate system errors at the medical facilities and It's just hard for me that there's an excuse for every absence. And I think it's hard for the court too. But she says the order is described as punitive because it requires the petitioner and her oldest son to vacate by may thirty first, despite her being the primary caregiver and despite Ralph's history of physical abuse towards their son. There purportedly was a video included as an exhibit that we don't have access to claims to show Ralph using their son. So she's basically arguing how could this be in their best interests if You know, I submitted this evidence. Yeah Drew suggests that the court's concerns regarding school attendance could have been addressed through less disruptive measures such as st compliance plan or requiring the respondent to handle school transportation rather than ordering her to vacate the home And she said, given the disparity in income and her lack of access to equity in the marital home, Drew argues that she is financially unable to secure alternative housing on such short notice. That did seem really punitive towards Drew. And if they didn't finish the trial, I mean, the court's going to do whatever it thinks is in the best interest of the children with the evidence it has in front of it. So that's not unreasonable of the court She should have a chance. I mean, assuming Wrew is saying is correct. Right. becausecause this is her motion. But also an inability to find a rental. She's making according to her thirteen thousand dollars a month. She should be able to find housing. But it's not just that, you have to move. I don't know. I hate moving. I do too, but it's a consideration of fairness And if she's making twelve thousand plus a month, I don't think her inability to pay makes any sense or find any rental property. I've been very open and honest about my dislike of Ralph, and so that may be coloring some of my opinions here. But if she didn't get to finish the trial and she didn't get to present all of her evidence and there were decent reasons for some of this then this does seem a little extreme to me. I do want to read this argument on page fourteen of her motion, even though it technically doesn't really have anything to do with the underlying issues in the order She does have an argument that he is intentionally disparaging her publicly and using basically the media to do it. Ralph has a healthy appetite for publicity. From the initial filing of this case, Ralph has sought to intentionally disparage Drew publicly. The level of utter disdain that Ralph has for his wife is diabolical Drew filed this case with the hopes that the parties would proceed in an uncontested fashion since they had discussed possible terms to dissolve their marriage. Unbeknownst to Drew, there was a raise to the courthouse. Oh, I do remember talking about this. how they had agreed that they wouldn't file until a certain date or whatever. and then Ralph went behind her back F Yeah, I remember that Rob's complaint for divorce was filed a little over an hour after the filing of Drew's complaint Ralph's complaint for divorce, filed on the same day was filled with salacious allegations in an effort to embarrass and humiliate Drew This was Ralph's first intentional publicity stunt. By september eighth, twenty twenty three, Ralph had been illegally accessing Drew's cell phone messages, WhatsApp messages and emails, and had provided same to multiple third parties such as producers of Real Housewways of Atlanta, the cast members and others in his quest to publicly humiliate his wife. We've talked about a couple times now how doing stuff like that can be very, very illegal. But if the phone was in his name and it was his account then there really probably isn't something she can do about that It says Drew had to file an emergency motion to ask the court to make Ralph stop. Oh, he was tracking her location from her vehicle, which is titled in his name and from cell phone, which was in his name. That's why he didn't get in trouble for it because everything was in his name. You're allowed to track your own stuff. G the account, the phone, everything is in his name, legally, it's his. If you're getting a divorce, get your own phone. get your own phone plan. Do not that's not legal advice. this is just common ense Get your own phone, get your own account. The theft and dissemination of Drew's private messages and emails alienated Drew from her friends and associates which was brow S T further torture Drew publicly during this divorce process and ruin Drew's name, brand and reputation, which has negative financial consequences for Drew's career. Even when a household bill was due, Ralph would ask Drew to pay, and if she could not, she could read about it all over the blogs. And then it says C exhibit C attached, and that's her emergency motion, which I'm assuming probably has some exhibits attached to it Counsel for Drew and Ralph's second attorne hadready agreed to seal this case in the order on Consent Motion to Seal case, which was entered on may thirty first, twenty twenty three. Additionally, the court granted Drew's motion for prrotective order such that neither party would disclose the other party's personal, financial or private information publicly. Despite this order, Ralph had no problem sending the party's financial, personal, and private information to blogs throughout this case And then they talk about how the court granted Ralph's motion to unseal the case on october ninth, twenty twenty four. Ralph posted several private text messages between Drew and Ralph to his ex formly Twitter account at Ralph Pittman junior from june tenth to twelfth, twenty twenty five, which landed on numerous gossip blogs. Drew had to file her expedited motion for contempt against Ralph on june thirteenth to stop Ralph's continued intentional efforts to maltreat, vilify, intimidate molest, and harass Drew in direct violation of this courourt's mutual restraining order During the week of july fourteent, twenty twenty five, when this honorable court afforded Ralph three days to hear just one of his motions Ralph was caught trying to record the hearing. Ralph had to be admonished by this honorable court and reminded about the prohibition from recording court proceedings. Coincidentally, Drew learned during that three day hearing in july twenty twenty five, that Ralph had gotten into her cell phone again and had texted screenshots of Drew's private messages with her attorney and other parties to his phone. Girl, have you not gotten your own phone yet It's super leegal if he's installing spyware on your phone without your knowledge. Go get a phone, your own phone right now Mhm Ralph had also modified a draft. of a message that Drew was preparing for her counsel in the notes on her phone screenshot his changes and texted the note to his phone to use in court. That is so bad. When this honorable court entered its amended temporary order on april second, twenty twenty six, for the first time since this case was filed onn february twenty seventh, twenty twenty three, a major blog released a story about said order on april tenth, twenty twenty six The style of this case remains with initials, so Drew questioned Ralph about why he sent the order to a major blog. Ralph did not deny that he had some involvement in getting the order to the major blog. Once again, Ralph's wish has been granted to embarrass and humiliate Drew to the point that her name, brand, and reputation are all compromised. I have no doubt that that is exactly what he's trying to do. Yeah, I mean, to play Devil's advocate though, the evidence presented exists You know what I mean? The fact that the children were missing these dates and stuff. We're missing so much school, We're missing court mandated therapy appointments under her watch. But she didn't get the chance to put her evidence on. It's incomplete evidence. This just seems so unfair to me in so many different ways Yeah, it says Drew was not afforded any time to put up her evidence and testimony to refute Ralph's motion that was heard in july twenty twenty five. although Drew was allowed to have her mother testify out of turn via Zoom, but Drew's direct evidence and testimony on the subject matter was never heard by the court. Regarding the appointments that M. Pittmaniss was psychiatist professionals of Georia it was determed that the discharge letter constituteed improper discharge says letter was due to the Medical Practices system status reports from the following dates blah, blah, blah, Both parents were present together for this appointment negating any suggestion that the discharge was attributable to Drew alone. O the occasional issue, Drew and Ralph arrive second short of the office's ten minute grace period, with the delay being nothing more than the time for both parents to gather themselves and walk together from the parking lot after parking separately. Although Drew agrees it was an unfair As consequence, rather than accepting it graciously, Ralph became furious, raising his voice at the practice manager upon being informed that the appointment could not proceed due to his lateness. Ralph's conduct was sufficiently loud and disruptive that E Pittman, the child who is there as a patient, made visibly uncomfortable by his father's behavior. This honorable report may recall Ralph's wrath when he is angry As presented from the audio of the video exhibit tendered at the hearing on february fifth, twenty twenty four Her attorney goes through and explains all of this. and then she has exhibits attached about the school appointments. The thing is, though, the court can only go off of what evidence was presented. Obviously her evidence wasn't presented in full. They will have the opportunity to do that. I think there will be rebuttal evidence that's accepted later. This is a temporary order. So the court had to just go off of what was presented in court to it, which sadly was incomplete, but was presented and they have to move forward with what they have. What is the current status of this now? It was denied Oh my go. Yeah, Her motion for reconsideration was denied, but I'm assuming and there was no written order. It just said denied I'm just assuming that the court's denying it because the evidence will be considered at some date in the future and not necessarily because the court doesn't want to hear the evidence. I'm just assuming that it's because it's going to be heard down the line. orrible So she has to vacate the marital home by may thirty first, twenty twenty six, and she doesn't get another hearing on this and she didn't get to present all of her evidence. It's undisputed that she makes less than half what he makes.. This is infuriating. For the court to impose a displacement deadline that falls only weeks after a hearing already on the docket rather than simply preserving the status quo until that hearing could be conducted reflects punitive treatment of Drew for no apparent reason. I mean, I don't disagree with that from the information we have. The degree of urgency imposed by the court is not justified by the record in this case. The court could have simply ordered as it did that Ralph be responsible for getting the minor children to school on time until the end of the school year without displacing Drew and her eldest son before the final trial could be completed. I mean, that seems reasonable to me. The harshness of the amended temporary order against Drew is what makes the order seem so fundamentally unfair and punitive. I am agreeing with her attorney here from the information I have. That's crazy. Be careful who you marry y'all. That's where we're at on that. It says that Kim and Croy were lawfully married on or about november eleventh, twenty eleven and since that day they lived together as husband and wife Approximately until the filing of this complaint which is february twenty twenty five, at which time they were separated and have since lived in a bonafide state of separation. They say the marriag is iritually be broken, blah blah blah There are four I didn't realize it was four kids. I don't remember that. They have four kids together And the parties have two other children as well, but they have reached the age of majority, so they're not an issue. And Croy is asking for primary custody of the minor children and exclusive temporary and permanent use of the marital residence at the time And I hadn't really seen this, I think it's not so uncommon in divorce petitions, but Cy put in the divorce petition to place Kim on notice of spoliation of evidence, stating that she is notified that Georgia law requires and this says him This divorce attorney probably just copied and pasted and you meant her. but to exercise reasonable care to preserve relevant evidence issued in this case, and so to not destroy or alter any video, audio, paper, electronic files, including emails, text messages, or other data, income records, tax records, expense records, all of that. Did we mention that this is the maybe third divorce petition that's been filed between them? I think we discussed the first in one of our episodes. So the original was filed may eighth, twenty twenty three. Then they dismissed the action, or petitioner did. Then august twenty fourth, twenty twenty three, there was a second petition for divorce. Then it was jointly dismissed february twenty first, twenty twenty five. then february twentieth, twenty twenty five, they filed the third petition. Just remember people being like, are you gonna cover The next one and I was just like, well I kind of don't want to jump into it if it's going to get dismissed again. so I kind of wanted things to happen before we to it And that was wise. because the last one we covered did get dismissed. Yeah. But this one seems full steam ahead. I think it's going to be and partially because I think there's quite a bit of evidence that Kim has found someone else that would appear to be an endless stream of money I don't know what that woman does, but she seems to always be able to find What's a nice way of putting it? a wealthy patron Oh my God, do you know Big Papa die? No big papa die. Oh my Godd. Two weeks ago. First of all, if you haven't watched the early seasons of Real Houseays of Atlanta, you need to go watch those. But Big Papa was Kim's benefactor. But yeah, he bankrolled her life. Yeah. She wasn't allowed to talk about him on the show so that he was referred to as bigig papa, but he funded her life. and he was married to someone else. And so she was his, I guess mistress or whatever. Yeah. so he died april eighteenth, twenty twenty six at the age of sixty eight and they haven't disclosed a reason. Wow. She's pretty young. That's pretty young Mm, specially when you're that wealthy and can afford all the medical care. Yeah. byy big papa She's like a cat with nine lives that gets thrown out of a building multiple times. I do think she does a lot of sponsored posts still because she has a huge following do know she was trying to sell her bags on TikTok lies That was interesting. What kind of bags is she selling? Her designer bags. You know they would smell like cigarettes Yeah, it was her and Brielle's bags that they were trying to sell. I would also want them authenticated. Yeah, for sure. Okay, so there's various pleadings in here. This is another really messy, messy, messy divorce I will say it doesn't seem to be like we're dealing with A Ralph Pitan here, Croi seems really pretty reasonable and then Kim seems to be kind of just responding and then It's contentious, but it doesn't seem to be necessarily they're out for the Jagular per se again. I do side eye him though after all this. I don't know dismissing it multiple times too and getting back. becausecause he made some really strong accusations against her in the last divorce proceeding. I's like, oh my gosh. Everyone's stupid at love, so I don't, I mean Even the smartest people are bad at that. But She does seem to be more of the problem. at least with money things, and all the kids seem to really like him. So I give him some credit there. but I think his biggest problem is his feelings for her just, I don't know. I don't know how she does it. Keeps getting people to give her money and the benefit of the doubt. and I don't know, it's crazy. So Croy I forgot that he's very religious now. Oh, is he? Yeah. his first post that you see on his Instagram, which was posted the end of January of this year. I just remember people sending it around and it's him holding a Bible like this. Oh my God, like this It's interesting. Pformative Bible holding. Yeah, okay But he does put in his bio domestic abuse survivor. I mean, so it is a pattern to continue to go back to your It is abuser. so So I mean, he has filed motions for contempt and sanctions against Kim. And this was interesting because he's talking about discovery they sent in December of twenty twenty three. So in one of the previous actions that they dismissed. And I'm like, I don't think that's how that works. I think when you dismiss something, that's no longer at issue. And that's kind of what she argues in response they've tried to mediate That did not go well. They mediated in January. They had temporary custody. It looks like they kind of had some agreements. There's a temporary parenting plan for the week of march thirtieth, twenty twenty six. they talk about how ple of the minor children still remain in the mother's physical custody. and then some sh'll remain in the father's physical custody pursuant to the previous temporary parenting plan. So it says beginning from the time the children are released from school on april third, twenty twenty six, until mother completes four sessions of parent therapy with a specific counselor but no earlier than april thirteenth At the return to school, all four children still remain in the father's physical custody Prior to mother, so prior to Kim resuming parenting time, the Guardian Ad Litem must independently verify that Mother has completed her four sessions of parent therapy. When this was april second when this was ordered, we' like you need to do your parental therapy before your parenting time resumes. So on april twenty second, twenty twenty six, not long after Kim was ordered to complete those four sessions of parental counseling. Croy files a motion for emergency slash expedited hearing for imediate change in custody. So the Guardian Md Litum stated Kim has demonstrated that she cannot abide by the safety plan, a key component in reunifying these children In addition, the children seem to be doing well in Croy's custody Cori has been compliant with the safety plan and has ensured the children are continuing in therapy and has agreed to by the parties. The guardian expressed her concern, saying there absolutely needs to be a safety plan in place and the children should all be on the same schedule I continue to recommend both of those as well as Croy having primary custody Given Kim's failure to follow the safety plan regarding counseling or being present to facilitate the gradual reintroduction I have concerns about her parenting time And then it says that Croy is prepared to show this court through expert witness testimony that Kim is both unstable and unfit as a custodial parent, and the children must be immediately placed in the primary custody of Croy. and then Croy also seeks all final decision making authority. And he says it's imperative for the children's emotional mental health that Croy be granted primary physical custody of all four children and mothothererss access to the children be limited to visitation as recommended by the Guardian Ad Litum in coordination with appointed psychologists and therapists Okay, so then there's some witness subpoenas for this hearing that's coming up. On april twenty seventh, twenty sixth, Croy subpoenaed doctor Jacqueline Zon, who is from Premier Psych EVals. And then he also subpoenaed Tracy from the counseling that Kim was supposed to do.
