Both cars were in the driveway. Her phone went silent Bank accounts went untouched, and her nine year old daughter was left behind Her husband, Dale had an explanation He had stolen money from the business bag, escaped to Florida, and caught a ten dollars boat ride either to Jamaica or Mexico. where she was living with a drug cartel For three years, that story helped just enough oxygen to stay alive Because sometimes People really do just walk away Not this time Join me now As we examine the disappearance of D Warner A mother of five who vanished from her own farm one spring morning You'll hear how her family, her community, and eventually, more than one hundred state police officers searched for Dee for three years. while the truth sat far closer than anyone realized, waiting for a detective willing to start over from scratch family's roots in southeastern Michigan stretch back nearly two centuries. Since the early eighteen hundreds, generations had worked the same Lenawake County land raising dairy cattle and cultivating fields of corn, wheat and soy. The farming community is where Dee Hardy was born in nineteen sixty eight cut from the same cloth as the land she grew up on. Vibrant, hard wororking, independent, and tough as nails Throughout her life, Dee carved out a career in the trucking and agribusiness world the same industries that shape the community around her she married had four children, and when that marriage ended, she kept building Her family described her as both generous and stubborn A woman who spoke her mind relentlessly and had no patience for anyone who tried to micromanage her Then, in two thousand six, Dean married Dale Warner And together, they built DDW investments. A trucking company that employed about fifteen people and generated roughly three million in annual revenue They also farmed around fifteen hundred acres and ran a fertilizer and chemical company All of it, operated from a sprawling property on Munger rooad in Franklin Township twenty twenty one He was fifty two. Grandmother with four adult children and a nine year old She had with Dale. But after fifteen years of being together The marriage was beginning to fracture. came nearly every day Al almost always about money or the businesses had been talking about divorce for years telling her children, she wanted to sell everything. M be done Talking and doing are two very different things Then came Saturday april twenty fourth twenty twenty one that weekend adult's daughter Amber, was spending time with her half sister Angelina It Saturday morning, maybe between nine and ten. she came to my house to pick up my sister, Angelina for a soccer game About an hour and a half to two hours later after the game, betweenetween eleven and twelve, when she came into the house. I was at my desk in my room She came in the house and directly into my room. She was hysterically crying. She sets her phone on my desk with a text message opened Somebody was mad at her for getting in their business. At the end of the tax message person said something along the lines of even your husband says you're a mess and takeake Xanax And she went after she set the phone on my desk She went directly into my bathroom connected to my bedroom. and She threw up and was crying And just saying she was done. She said, we're selling everything, I'm done. She's done with her marriage. I went into the bathroom to comfort her and then I had to get back to work. so she sat with me and kind of just tried to pull herself together She sat in my room. And then she had an appointment to get her lashes done. So she was trying to pull herself together to do that What made the text so disturbing to D was that it revealed Dale was speaking disparagingly about her to their employees. C ran a multim million dollar operation alongside these people Oh while Dale was undermining her behind her back Amber had seen her mother get angry with Dale plenty of times before This time felt different I called my sister, Raquel. I was worried about her That evening. Dee had arranged for Angelina to spend the night at her sister in law, Amy Jo Alexander's house. told her she was planning to sell the trucking company and was going to ask Dale for a divorce But she didn't want Angelina to be inside the house when she confronted Dale. nextxt morning On Sunday, april twenty fifth. Tee's daughter Raquel woke up expecting the same routine that played it almost every week. and her boyfriend Dustin lived next door with their children on the property beside Dece's fararm In many ways, the two households functioned almost as one My mom watched my kids while they worked and then she would also watch them sometimes when I would help on the house. She helped me do my laundry. We'd eat dinner there almost every night Sundays, pretty much every Sunday we would eat breakfast, but we would always go grocery shopping on Sundays Cell Dustin and their kids arrived at the farm around nine AM expecting the usual Sunday breakfast. Nobody was home Even though both of these' vehicles were on the property Her Hummer and Cadillac escalade The Hummer was parked near the farm's office building Not by the back door had been parking it for the previous month when Raquel texted her mom gototten a response. And once you called, it went straight to voicemail So she and Dustin started looking for Dee The Warner Firm Amonger Rodad was massive A house, an office building Multiple barns, equipment sheds, dozens of vehicles and pieces of heavy machinery scattered across the property. Couldn't find D Kell reached out to her brother Zach, who was also an employee on the farm I worked for her, so I worked there at the farm So I typically saw her Monday through Friday. I had worked there when I was in high school, but had left and was doing my own stuff. I came back. I want to say it was about twenty seventeen. saw each other just about every day. We'd talk through text message, phone call, snapchat, or we'd see each other in person sack was woven into every part of his mother's life. Eployee, conffidant Daily presence But his relationship to Dale was entirely based around the business There's DDW invvestments, which was the trucking company. There was trucks that went in and out of Canada. There was trucks in Illinois K kind of all over, I'd say a couple of states surrounding the state of Michigan Wargg Farms, which was the farm operating company that farmed ground cororn beans, that type of thing And then there was Wari Farmed Services, which was the chemical fertilizer company that was selling products to third parties, other farmers On Sunday, april twenty fifth. Zach remembers his sister reaching out to him My sister, Raquel had, I don't remember if she had called me or texted me. I believe she had called me that morning and asked if I knew where mom was She said that both of her cars were at home and she couldn't find mom anywhere and asked if I knew where she was U And I said, no, I'll text her and then I'll come on over. So I got off the phone with her and tried to call mom. It went straight to voicemail. and then I think I had sent her a couple of text messages and it was just starting a conversation. I think the first one was something like How was your night or how you doing today or something like that. Nothing ever went through past She had stormed off the farm for one or two nights, following a big fight with Dale Typically the fights were related to money and something related to one of the businesses I She was done with everything. She didn't want to do the trucking company anymore. She didn't want to be with Dale anymore. She wanted to sell everything and be done. Tension between Dee and Dale wasn't unusual Dee had never once failed to respond to Zach I first went down to the office. I remember seeing my mom's hummer sitting there, which was a little weird because she had been driving the Cadillac mostly. and then I went into the office kind of just ran through, I guess all of the rooms that were there looking to see if I could see mom or anything If mom had been there and then walked back out of the office, got back down, started to walk back up towards the house, and that's when Dale came up to me somewhere in the driveway and asked if I knew where mom was, if I knew where she was going to be, anything. And I said no, and we bothalk proceeded to walk back down to the office As soon as we walk in the office door, we take a write I was going to go look at the server room, which is on the back little hallway thing next to the bathroom and Dale started to walking into the next door, which was his office. So as I took a left to go down the hallway towards the server room in the bathroom, Dale was standing in his doorway and beforefore I got to the server room, all I hear was A And I turned around and Dale standing there holding my mom's wedding ring his hand in the doorway In all the times D had left for a day or two. she'd never left her ring behind A few years ago, I hit a point where stress was piling up faster than I could manage it. Between my day job and the podcast, I was essentially working two full time jobs, and because of that, I had little time for myself or my family. You deserve mental health care that works for you, not against your budget And so then from there, I walk back around over to my mom's desk where her computer is connected to the camera system. and I started to get on the cameras to see, well, if Dale's holding her wedding ring, she came into the office at some point. so maybe I can see her on the cameras and what time that might have been I stayed in the office trying to look on the camera system for a little while. I couldn't tell you exactly how long All of Dee's children came to the farm that day to help search for their mother Together, they spent hours watching the surveillance There was no sign of D on any of the cameras The rest of that day, I had gone through and I went and drove to look at the other properties that they owned that had structures on them. So like there's a house around the corner that used to be rented that we were selling at the time. So I thought, well, she walked somewhere, her cars are here. Maybe she walked and is staying in that house drove up to that house, opened it up, nobody was inside. I drove over to the Cedar Point property in Onstead to see if maybe she was there somewhere hiding out. I went back to my own house, figuring, well, maybe somebody picked her up and They went to breakfast and now she's back at my house hiding out. she wasn't there By that afternoon Zach was worried enough to reach out for help When I couldn't find her anywhere, I called a friend of ours officer, Paul Wolf for the Teumsee Police Department. I told him what was happening what I was feeling like and he said, then you guys need to call the state police. So I got off the phone with him I called my siblings. I said, Hey, this is what Paul said? Can we meet at my house and we're going to call someone? That evening, deputies from the Linaway County Sheriff's Office arrived at the farm. Phone records soon showed D's cell phone had last pinged on a tower covering the farm itself. Sing came in at seven fifteen AM And after that, The phone went silent. Dee's brother, Greg Hardy, joined the search as well He still remembers his first conversation with Dale about his sister's sudden disappearance He said, Well, she took off. We had a hell of a fight. She left. and I said, Well, what do you mean? she left? He said, Well, she took her bag, her curling iron, makeup bag, her phone, and maybe one or two other things that he mentioned. and she took off and then he reached in his left pocket of his jeans and pulled out her wedding ring and was bouncing it up and down like a golf ball From the beginning Greg sense something was off about Dale's story When I questioned him where Angelina was and how D would have left He didn't mention that she was not there. His theory to me when I asked him was that somebody must have quote unquote, picked her up Greg never believed Dee would have abandoned her daughter That's when he started calling people. Nearly a hundred of them Anone he could think of who might have given Dia a ride or knew where she might be. Nobody had. After a week of getting nowhere Push Dale to step up the family's efforts to find Dee you know, we've been working My family and I and everyone that I knew are friends of Dee' had been working heavily to try to find her. and it just wasn't adding up. And so I requested Dale to come to my office Sunday morning in which he did do. and by this time was getting pretty stern about this. I told him that I thought he should offer a cash reward for the public to find his wife I got really no significant interest from Dleen and wanted to make it public. I did it with podcasts. I did it with news media. We're very helpful and you depend on your friends to pass the word. and that's how I did it. I did it with billboards There were two or three standard billboards and then there was a very kind gentleman who had a billboard company in Tolo, It electronic billboard that he offered a message trying to find a As the week went on, I decided that perhaps we should take a search party with family and members of the community who were willing to and walk the properties just to make sure that something wasn't out there somewhere. D wasn't somehow got away one out and self harm or been hurt or whatever happened. and tried to just check that box off to make sure we couldn't find her anywhere Greg's team of volunteers painstakingly searched more than four thousand acres looking for D And when Dale refused to offer a cash reward did it himself Offering up a fifty thousand dollars reward for information. Deputies investigating the case consider Dale a person of interest from the very beginning Dale consented to multiple interviews and searches of the property found was No sign of a struggle No blood and no evidence a crime had been committed But interviews with family, friends, and colleagues began to reveal a far more troubling picture of the Warner marriage One shappeed by suspicion Control and escalating tension Like how Dale liked to keep track of D's location at all times in Kell's boyfriend Pice, D had found a secret tracking device in her hummer the previous summer. July of twenty twenty Dee asked me to come and look at something that she had found in her humber He handed me a small black device. And she said, I found this in my hummer plugs into the OBD two sensor that all vehicles have and like I said, D gave that to me and asked me if I know what it is. Offhand, I did not know what it was. I did Google to find out what it was I said it was a tracking device top button, I pushed it in the device came apart in two halves There was an SD card inside of it. I asked Dee what she wanted to do with it. I removed the SD card, put the two plastic halves back together, and I handed both the SD card and the device back to Dee. She put the SD card in her pocket and then she turned around to head back to the garage with the device Deputies discovered Dale had also been tracking Dee's Cadillac through an onstar app And over a two year period, M show he checked the vehicle's location data more than two thousand times When detectives asked Dale about it, he brushed it off. Sing it wasn't a big deal In his words Husbands and wives do it all the time, right? He said he suspected D was cheating on him for a long time something Detectist would later learn was actually true Still The level of surveillance raised eyebrows Detectives then spoke to the farirm's IT consultant, Kyle Wagner And according to Wagner, Dale made a strange request the day after D disappeared I received a phone call early in the morning. It probably was between eight and eight thirty. He requested that we meet I was already going to be heading out that way to Hardy Fms, which I also provided IT services for them. And I said that I would be willing to meet at the office, which he indicated he didn't want to. So we ended up meeting outside of party Fms. He wanted the cameras put back on his phone. So the milestone server allows you to be able to access it through the milestone app that can be installed on your smartphone And I needed to update some settings with within his phone so that way he could be able to view the footage Dale then asked Kyle to remove everyone else's access to the camera app, including Dee's children pies couldn't help but wonder why When those same cameras were being used to try to find their mother Kyle also told police about a separate incident in twenty twenty Dale allegedly asked him to clone Dee's phone without her knowledge I received a phone call about regarding that Dee was having some medical issues, maybe even some migraines and was in the hospital and that she possibly could have been going under a medical procedure and the request was made for me to pone Dee's phone. I did not do it because I didn't have Dee's permission and I didn't feel it was right. across multiple interviews Sales account of what happened on april twenty fourth and twenty fifth remained consistent According to Dale They'd had a terrible fight that night. What he described as the worst argument of his life over money and infidelity After he said She went and slept on the couch. next morning. He said he left the house around six AM to start work on the farm. And As he left, he said T was still asleep on the couch, snoring away That morning, he said he went about his day. chores and spraying the fields around the property According to Tale He had no idea Dee was missing until an employee called herM ten thirty AM to ask where she was Deputies, he believed Dee had simply decided to leave him claimed she had a secret phone had struggled with prescription drugs. been embestling money from the farm He even suggested she may have fled the country with a drug cartel. Police would find little to either confirm or disprove those claims overver the next year The fararm was searched repeatedly Police B I Daver dogs and drones D. The search for D in the public eye Eventually, the Michigan state police stepped in to help. One of the detectives who would take a fresh look at Dee's disappearance was Daniel Dreuwer I was a detective sergeant for the State Police Monrou Post, which covers Monrooe and Mwake Cies. and the Seriff's Department had contacted the post and asked for some assistance with this investigation. That was in March of twenty twenty two Detective Drewer decided to reapproach the entire case from the very beginning. There were a number of administrative things that need to be completed, primarily taking all the current evidence and documents from the sheriff's department, inventorying them and entering them into our report writing system and property. There was a volume of documents, video, surveillance video, bodycam video. There was some physical evidence, things that had been sent to the lab for miscellaneous testing and electronic media So we conducted a complete review of everything that we took from the shheriff's department, reviewing all the evidence, all the reports, all the videos, but then also starting our own investigation from the beginning The gooal from day one was simple Finty Warner Throughout my time in this investigation, it has been focused on finding Dee Warner. So that could be in a number of different ways. If she's alive and well somewhere, obviously we want to find her. If she's not alive, we still want to locate her. So essentially discovering what happened to her, what caused her disappearance, and where she physically was One state police reviewed the case from the very beginning They started taking a closer look at the claims Dale made about Dee's disappearance There were several things Dale Warner stated that we investigated. The one that we spent the most amount of time on was the statement that she had taken some money from the business and had disappeared on her own means and was living somewhere off of that money. Think he use the term drug cartel. When detailing what he believed happens to D, his wife, D. Warner, he stated that he believed that she escaped to Florida or somewhere near the border and it escaped on a secret ten or twenty dollars boat ride and was living in Mexico or Jamaica with the drug cartel. We put a lot of time and resources into that portion of the investigation financial crime specialist, Detective Sergeant Scott Singleton, was assigned to trace the money A few months into assisting, probably around July, it was determined that we would start looking into the financials. There was a theory that she that his wife had stolen a large amount of money and was living out of the country provided records for the business accounts that he claimed backed up the embezzlement allegations He had indicated that there was upwards of a million dollars that they said was missing. and he gave me, I guess different examples of schemes that were to divert money from the business to her personally I mean, immmediately it became where that included in this million dollar figure was credit card charges on the business accounts that then they just paid off with the business money but they were personal. I wasn't concerned with that, but there was a lot of that. What I was mostly looking for was any hidden accounts that she may have, that she may be living comfortably off somewhere else O any cash that was unaccounted for. B did Jamaica or something of that nature? I traced as much as I could. and when things go to cash, it's a little harder to trace. but I did not find any secret accounts that she was living off of in Jamaica or accessing or anything like that. But I did come up with some figures of money that was unaccounted for It was about thirty four thousand dollars over a two and a half year period before she went missing While the embezzlement theory was still technically possible Without any evidence, Tank T to the missing money Druer didn't believe it explained her disappearance. Another statement he had made was that Dee Warner had a prescription drug problem and perhaps that had something to do with her disappearance There were several things that I did to look into that matter specifically. One, I reiewed I did search warrants and reviewed her bllue Cross Blue shield usage, which is what her insurance coverage for her prescriptions As well as her CVS records where she primarily filled those prescriptions. Separately, I reviewed records from something that is called MAapPS. MAPs is a database that's used by healthcare providers and pharmacists to ensure that people aren't going to multiple doctors to get the same type of drug. somethingomething to help prevent people from abusing prescription drug programs. You can't go to doctor A DN C and get Axy code on or Vic it in from each of them I found nothing that would indicate any signs of abuse of any scheduled narcotics Even though detectives were digging deeper into those theories than anyone had before, they still found nothing to support them Dale Warner statements that Dee may have had a secret phone was of particular interest to us because as her primary phone showed no communications with anyone That would lead us to believe that she summoned someone to come and get her on four twenty five twenty one So discovering if this other phone existed and if she could have possessed it was a particular interest to us So through several search warrants, I did several things at try to obtain this information. I was not able to discover any device that could be the alleged secret phone The search for the secret phone Detective Drewer used a powerful investigative tool Google Gofen's Wrant, which allowed police to see which devices were present at a specific location during a specific time window. D had a secret phone. This should have been where it surfaced. didnn't One by one the explanations Dale had offered began to fall apart Detectives even looked into the man Dee had been having an affair with. But he was ruled out, after investigators confirmed, he was in Florida when Dee disappeared with those distractions eliminated Sruer turned his attention back to the facts at the Warner farm on the day of the disappearance. Because there were a few details that never quite sat right with them The first was Dce Hummer ne morning she vanished, he was parked in front of the farm office. But everyone who knew Dee said she always parked it beside the back door of the house One of the farm's truck drivers had even seen it there as the latest three twenty five AM just hours before she disappeared. So at some point Someone must have moved it. The second detail involved the farm's large JCB front and loader Multiple witnesses reported, seeing fresh tracks near the same door on Sunday morning Dale himself said he'd driven the loader up to the house around seven AM to grab something according to him He was still inside, sleeping on the couch It was observed. the retire tracks observed from the front end loader And when asked about it mr. Warner later explained that he returned to the house in the front end loader. Where those tracks were is also where the hummer is typically parked and where it was parked that day His statements D must have moved the humummer to the office But he states when he returns to the house in the front end loader and parks in this spot that she's inside sleeping. So then it begs the question of These two objects cannot be in the same place at the same time, which means the hummer must have already have been moved when he pulled up to the house On Dale and Dee had keys to the hummer So either Dale moved it and lied about it St had been awake that morning Which meant Dale was lying about that too Detective Dreyer believed it was both Even more notable. The area near the back door was one of the farm's blind spots Dale knew wasn't covered by surveillance en there was a forensic extraction from Dale's phone whichich revealed the apps he'd been using, the morning D disappeared At seven AM, he accessed Dee's My Cadillac app Th then around nine check the firm's security cameras multiple times twice around ten thirty. He used findind My iPhone to locate D. When detectives asked about it Dale said, he'd been using those apps to look for There was one major problem with that explanation He's very consistent in that the first time he knows that she's missing is when he receives a phone call at approximately ten thirty. However, he accessed all of these applications in his words to find her well before he knows that she's missing All of those applications were accessed by Mr. Warner that morning And they were all done prior to when he states that he realizes she's missing So if Dale didn't know D was gone Why was he already trying to find her twenty three Truer had spent more than a year reinvestigating Dee's disappearance from the ground up. chase down every theory Dal had offered And watched as each one collapsed. Gambling probleblem? Call one eight hundred gambler evenven after Dale's arrest Detective Drewer continued looking for D. thenen, in twenty twenty four His attention shifted to something else that stood out to him in the surveillance footage On the morning D disappeared Dale appeared to be going about his usual farmwork cameras repeatedly captured him moving in and out of frame with welding supplies There was one problem There was no footage of him actually welding anything At that time, I felt as though we had exhausted the type of searching that we could do. So to revisit this welding theory, I decided to try and discover what metal objects were on the farm that could have disappeared and somebody would not notice. So in other words, if she was put inside of something metal and welded, What could have been used that people wouldn't have reported, hey, wait a minute, this is missing now. which ultimly led me to the the search for ant hydress ammonia tanks On august sixteenth of twenty four I executed a search warrant to look for anthydrous ammonia tanks Dreyer's hunch was right Dozens of larorge harmonia tanks scattered around the Warner property large cylindrical metal vessels used to store fertilizer Some were still in service Others have been retired, men left to rust And no one had been keeping a precise inventory By august twenty twenty four Drewer had secured a search warrant to examine those tanks Dleo Dumb Peragon Road aboutbout four miles from the family farm There was one tank that stood out It was by itself Tag the red out of service. Bag tip tube Phil Initially, it stood out because all of the other tanks were outside and or in the open portion of the barns by one another. However, this tank was by itself in this area. On the what would be the back or the left hand side of the tank, there was a non factactory weld visible from the outside. I contacted a tow truck company and I escorted it to the Ambassador Bridge for an x ray The X ray images were haunting Inside the tank The outline of a human body was unmistakable tank was immediately transported to the state Cime lab inside of the tank, there was something wrapped inside of a blue tarp Once we gathered some videos and photos of it, we then continued opening the tank. Once it was open, we were able to remove the object that was wrapped inside of the blue tarp It was human remains I observe the remains of an adult female wearing pajama like clothing, wrapped in duct tape. There were a few small pieces of jewelry on her person, and she was barefoot For more than three years D's family had lived with uncertainty No That uncertainty was over Finding D was only the beginning of understanding of what had been done to her Dr. Patrick Cho try to answer those questions It was presumed at that point on august twentieth. The dental identification came later, verification of Deanne Warner. The body was actually wrapped in two polyethylene tarps that were secured with duct tape There was the body of an adult female. The legs were bound with duct tape. The arms were bound to the torso with duct tape There was duct tape over the nose, mouth, part of the head. There were what appeared to be pajamas, top and bottom in underwear Because the tank had been sealed in an oxygen deprived environment 's remains were preserved in a way that gave the medical examiner unusual clarity about her injuries and how she died Once the tape over the head, face, and neck and arms were removed, there were contusions on the right and left cheeks, lateral aspect of the left eye, contusion on the left shoulder There was a small Contusion on the back of the head as well, the scalp There were obvious blunt force injuries of the left, temporal parietal scalp regions and on top of the skull There were subdural hemorrhages over the brain. so that's indication of blunt force injury. There were bruises about the tongue, and there were picial hemorrhages on the epiglottis cartilage tissue that as we chew and swallow food or drink water, it'll close over the windpippe so we don't aspirate The official cause of death was strangulation. Along with multiple blood force injuries, Dadise's head and face manner of death H aside Discovery changed everything What had largely been a circumstantial case was now something far more concrete A homicide investigation with a body An autopsy and a confirmed cause of death Fbruary, twenty twenty six Dale Warner went on trial charged with open murder and tampering with evidence Now Twelve jurors would decide whether the evidence proved beyond a reasonable doubt that the man who claimed he had simply walked away. was the same man who made sure she never could The prosecution began by laying out the theory of what had happened Starting with mod of She comes to Amber's house and she's distraught over that message She was throwing up. She said, we're done, I'm selling everything. I'm done with the marriage. She had been telling him, things have to change. thingsings have to change. and they weren't changing. She was going to tell him that night that she wanted a divorce that she was selling the trucking company and she was leaving. State argued that the confrontation between Dale and Dee on the night of april twenty fourth was the catalyst for what happened next From there, prosecutors laid out how the cell data, surveillance footage, and Dale's own statements pointed to a window of opportunity to move Dee's body that morning without being discovered seeven AM, you have the defendant driving around on the JCB to go do his farming chores. Every statement Dale has given is that Dee is snoring away when he gets ready to go spray that morning. Dale Warner pulls his JCV up to those back doors and loads his wife's body into that bucket. The next thing that happens is at seven fourteen AM in twenty one seconds, D Warner's phone staffs communicating with the towers instead No service Deil Warner then goes to spraybarn and he places her body inside there because he knows that she's not going to be found in there Inside the spray barn was a large safe. Big enough. Cceal a body inside The prosecution argued that Dee had been hidden there until Dale was able to weld her body inside the ammonia tank later that afternoon The april twenty fifth, twenty twenty one surveillance footage shows Dale gathering all the welding accessories Dale's internet searches over the following days also painted a dark picture Their continued search also uncovers internet searches, widowowers, dating sites, chemical cremation May fourth, twenty twenty one The defendant searched for how to dispose of a thousand gallon propane tank The state's most damning argument came from the discovery of Dee's body itself Because if T had never left the property alive prorosecutors argued That left Dale as the only person with opportunity to have done this She was found in her pajamas Andee would never leave her house and her pajamas alive. No socks, no shoes. Pajanas, no bra The defense argued that the state's case was entirely circumstantial on speculation rather than proof What you are here to determine is that the government has proven its case against Mr. Warner beyond a reasonable doubt and it didn't government speculative theory is that Mr. Warner killed Ms. Warner in the House while not leaving a single trace of physical evidence. notot a drop of blood No bodily fluids, no signs of a struggle, absolutely nothing Then mister Warner supposedly moves the body, but there's no physical evidence of that. Nothing to show that she was ever in the JCB at all. only speculation There's nothing on camera and there's no physical evidence. There's no evidence whatsoever to support the theory. So while the government has shown you videos of Mr. Warner doing his chores and moving about the farm They have shown you no evidence to support their theory of what actually happened. Assumptions are not evidence. After more than two weeks of testimony and arguments, the case was handed to the jury Members of the jury, listen to your verdict as recorded You do say upon your oath that you find the defendant, Dale Warner as to count one Guilty of second degree murder as to count two guuilty of tampering with evidence. So say you, mister Ford personerson?. So say you, members of the jury.. T Test the charge was open murder, it was up to the Michigan jury to decide whether the evidence supported first or second degree murder The second degree verdict suggests the jury couldn't find premeditation beyond a reasonable doubt that whatever happened likely unfolded in the heat of the confrontation on the night of april twenty fourth, rather than a calculated plan On may eighth, twenty twenty six Dale Warner was sentenced to between thirty and seventy years in prison.
