And yes, all of this having to do with the case of Carmelo Anthony, the teen who was just convicted and now serving thirty five years in prison for stabbing another Texas teen at a track meet. And with that, welcome to this episode of Amy and T.J. Res it was heated before the trial, during the trial. and now it seems going to be heated after the trial. There's a lot going on. Yeah. I'm actually so surprised that the headlines just keep on coming. This obviously was an emotional story and emotional situation that certainly played out in court, but it doesn't feel like anyone is truly satisfied with the outcome and Perhaps even with what happened inside the courtroom, which was supposed to lead with justice and a finale and closure and all of those things None of which seemed to have happened. Yeah this thing was heated and I guess robes it No matter what the outcome was going to be, there was going to be somebody arguing this point. There was no black juror U So he had a jury of his peers and we'll get into that as well. That That statement about a jury of his peers and whether or not he had one is the thing that now has the view kind of knocking heads with the father of the victim, Austin Metcalf's dad. So and he's made some comments Robes that has taken this It's hard to for a lot of people to feel sympathy him He lost a child. obbviously you're going to be sympathetic to that, but he's saying some pretty outlandish stuff. Well Ironically and I use that word deliberate because he was very big on saying this isn't about race. let's not make this about race and then said Well, they made it about race. And then he really escalated the racial conversation by some of his chosen words and phrases. and they were chosen. And we are not going to have to paraprase for you. We're going to let you hear that for yourself here in just a bit. But Rosevelvers is just last just weeks ago, we were talking about we saw Carmelo Anthony get thirty five years in prison for that stabbing and we are getting word. We knew this pretty immediately. They are appealing his conviction Not sure Robes if they will go directly after the conviction or if they'll just go after the sentencing, but he does have a new legal team in place and Res This is a This is a hell of a robster of people he has going to represent him now for the appeal. Yes. And look, he had filed, I believe, at the time of sentencing that he What did they call it a popper's plea? We're basically saying he couldn't afford to have the legal defense team he had before. This is all an incredibly expensive endeavor to defend oneself in criminal court. But then now to go through a lengthy appeals process and all that that takes, this is just, we're talking about like an exorbitant amount of money. So most people don't have the kind of money to keep a high profile defense team in place. so you get a court appointed attorney. Well step in a new legal team who has agreed to handle Carmelo Anthony's appeal pro bono. correct? And this is a squat. He has a squad Now these might not be household names and maybe not even that big a name outside of Texas, but these folks have been practicing for decades and decades. several of them are attorneys who have their own firms and ropes, he collected folks who have specialties in Aellate court Civil rights attorneys and criminal defense attorneys. Yeah, they knew what they were doing. These are folks who have been there, done that and absolutely understand what it takes. to take on a case like this with this type of riny And look, it is that public scrutiny that probably drew these names to this case. And we're talking Russell Wilson. He's got his own firm there in Texas, Michael Wayer, Justin Moore as well, but Rose that luse is the damn chief of staff to Ben Crump The Ben Krump laaw firm. Yes She kind of knows what she's doing. Yeah, and it's certainly when it comes to civil rights cases or certainly cases where there are racial implications. But yeah, he's got one, two, three, four, five, six attorneys on his team now. And so yes, this is certainly going to give him the best possible opportunity to see if there was anything That was untoward or anything that happened that shouldn't have happened in that court and starting with and probably not limited to the makeup of that jury Yeah, and again, that's what do they call them? When you can strike the jurors. I wonder if that's going to come under scrutiny here. You can't strike a juror because of race They are going to try to make that argument that several were struck Here Here's the confusing part to me, and I know that neither one of us and we've said this plenty, but neither one of us are legal experts. But we have watched a lot of trials over our three decades in this career. And I'm curious because the last three black jurors who were all struck were female educators. And look, the defense said, hey, you just struck the last three black jurors and said is this is not okay. this is completely illegal and grounds for an appeal. And the argument by the prosecution was no, we struck them because they taught child or they were educators for young students or for students. Why wouldn't you want educators and teachers on your jury when you're talking about high school students where a fight got out of hand that ultimately ended up with a kid dead and allegations of murder. Wouldn't that be exactly the type of juror you would want? The prosecutor would want Yes, absolutely not because they might see that kid as a kid because they might be sympathetic to Carmelo Anthony. they might have been teaching black boys who are sixteen and seventeen and seeing them be afraid, seeing them get scared, seeing them even heard them talk about their fear of being around too many white guys they had an opportunity to be I guess balance out the jury in such a way that somebody could relate maybe to this kid as a kid Because they were black teachers. If they were white teachers, would they feel the same? That is my argument. Yes. That is what the prosecution was claiming. There it is. abbsolutely. I think an educor Absolutely. I don't want an educator because They might be sympathetic. And I think yeah, same thing a white teacher absolutely. But hereere's me thinking, why wouldn't you want it to be a fair jury who would be able to consider all sides and allt of the evidence. But then again, I forgot, oh wait, this is my side versus your side. This isn't about justice. This isn't about finding the truth This isn't about tiny the sort of. It's about winning But yes, and that But winning is supp both sides think they're winning for whatever side of justice. Yes, they did. All right, so we did hear directly from the attorneys, this new power team, this new power legal team representing Carmelo Anthony. and here's what they had to say. Our appellate team has been retained following the conviction to conduct a fresh independent review of the trial record reconize profound loss suffered by one young man's family and the uncertainty facing another, and we extend our respect to everyone whose lives have been forever changed by these events Our responsibility is to determine whether a legal error occurred and to ensure that every issue supported by the record is full and vigor vigorously presented on appeal, the appellate process exists for precisely this purpose. You know what? I like that line in particular where they're saying we recognize the profound loss suffered by one man's family. and the uncertainty facing another. It's a way of addressing and recognizing both families are suffering without doing some comparative suffering without actually saying, well, they hurt worse or you all are a little less or one is more important than the other. And then they also mentioned Austin's family first. I just thought that was a great way to balance out to address that there is profound loss and then there's uncertainty, which is driving both of these families crazy. just I really appreciateated the way they put that in their statement Moving forward here, Robes, a big part of this conversation has been and it was immediately after the u the verdict Austin Mcab's dad. U I guess he was in court quite a bit and we did hear from him quite a bit and Robes we heard from him early on And it was complimentary Um, people were complimentary of him because he did make statements of just, hey everybody, let's not make this about race. Yes, he very much tried to, it seemed, keep some of those emotions and some of those someome of the finger pointing, he was trying to bring down the temperature. It was pretty obvious from the beginning that this was People were taking sides, basically. And so he really tried to say, hey, this has nothing to do with race. This has everything to do with just basically egos or anger or other issues It has nothing to do with the fact that one person was black and the other person was white However, doesn't seem as though he is that he is going along with that way of thinking anymore. This doesn't make sense to me. Well I dont if this is what's on his mind in his heart and need to get something off his brain, then then that's fine, but this doesn't This conversation And in Rome, it makes people look at him And his family and maybe his son differently. We've always said no, don't think the crime was about race. Awards, yes, it became In the moment, there was no argument anywhere that one kid was being racist in some way or something to the other. anything was said No, but now roes This fuel heat through on this fire Rroves, this is beyond just saying something offensive. This is flat out Racist. Racist. just flat out. So he w went on a podcast R I can't remember the name of it here, but there is video of it, but he's sitting here And he's just giving his commentary and Robes he starts going off First about black jurors We'll let you hear it for yourself. and this is beyond beyond offensive There was no pagers You know why? Be you can't be unbiased, you dumb shit. If you answer the question, I can't send a black man to jail because he's black get on the jury You're so unintelligent, you can't even fill out a form correctly You don't even know who your daddy is because seventy eight percent of you don't have your father in the home anymore You got Baby mamas running around with eight kids so they can get EBT cards to feed you all You think I'm being racist? No, I'm being real Beause they didn't only black people, White people do the same Uh, yeah That's that's daddy. enough lies in the face of what he was saying before the trial and that is deeply disturbing to hear now. Like I felt my skin brawling, listening to that Are you just like, yeah, I'm not surprised Uh, no, something not like this. It's, um I guess I'm getting a little more surprised that people are so emboldened to just say it out loud, to just say it in public, to put it out there. started to surprise me a few years ago, but even that to this point. Wh gives a d. I do wonder how much this current administration has embolden folks to say what they think or what they want to believe to justify how they feel. I really do think sometimes You get emboldened because you hear other people and then you want to be able to justify either your feelings or your actions or to explain something that you don't want to take responsibility for. And so it's just very easy to fall into comomments like that, but the damage that those comments do I don't even know where to begin You know, there's some there's other things he said and you heard as well, Robes where he was attacking Carmelo Anthony's parents where I can't remember the name or certainly threw a name at his dad, but called his M a drunk sayay your mom's a drunk What kind of kid did you raise that goes around stabbing people Um It it went it went beyond like somebody if you're just angry it're just mad at the world coming. he lost a child Res foot. It's not supposed to make you racist. No. and look, he has every right to be angry and hurt and piss. Mad as hell. And look, even hearing him give some some interviews about how he wanted there to be some sort of conversation or some sort of remorse or some sort of apology from the Carmelo Anthony family. And when he didn't get that, then he felt emboldened to just spew hatred. And look, I understand where he's frustrated and angry and you would like that Sadly, unfortunately, this just makes things worse just divides people further. It builds that hate and that weight on your heart. It' it's tough to witness and watch and to listen to. and it's sad because you just see where this is headed. You said that major skin crawl. We are talking about The fallout The continued divide that this case, Carmelo Anthony, the trial that took place what a couple weeks ago, The verdict was in. He was sentenced to thirty five years for the first degree murder of Austin Metcat. that both of them were seventeen years old. This was all at a track meet in Texas last spring. and now you've got parent, the father, specifically of Austin Medcf He's getting on podcasts. He is voicing his opinion and he has a lot of anger. And he's speaking very differently than he did before trial. So yes, we know the Carmelo Anthony's team has filed an appeal. This is far from over for them. He has a a powerhouse of an attorney squad, so to speak that will be filing this appeal. But in the meantime Ain met Calf's dad Look, he is firing shots. He is angry. and one of the people who he has pointed out and talked about is one of our good friends, actually Sonny Hostustin from the View they through their hot takes. We know they're not shy about giving their opinion, but he in particular Robes took issue with her.. It was just yesterday. Yeah, it was just yesterday. She was Oh yeah, the interview you' referencing he ended up doing yesterday as well. They're discussing this case and the new evidence that was, excuse me, it's not new evidence. It's the evidence of the case that was just released to the public to see. So we're seeing a lot of that stuff for the first time And she was talking about that and said, Robes She didn't think that he got a jury of his peers, and that was part of what the dad took issue with. That's right. And when she said that look, there were a few people of color, I'm not sure. we never did we get the actual ethnicities, but it was a mostly white jury. But notably, there was not one single black juror. And so Sonny yeah mentioned that matters that that isn't a jury of his peers. And Austin Metcalf's dad said that woman, he referred to her as that woman, has no idea about the facts of the case, but she wants to spew her public opinion on a platform that reaches millions of people every day. Look, that woman, Sonny Hassen, I know she was not a part of this case, but she was a She is a former prosecutor. She is an attorney and she No, yeah. she was a former federal prosecutor. It isn't as if she's just some random person saying what she thinks. She actually is speaking with a significant legal resume Um, yeah, and this is one I guess look you all You give them a pass and you give them Yeah Re for the pain, he's going through something like this canan't on the other things, Rbe. It's just it's Yes, yes, you're losing a family member, losing a child is not something you put in as an excuse. for spewing hatred. And you just said that I hadn't found the right word, but that's what he is doing is spewing Hatred and who knows why? And We mentioned the podcast. We let you hear a sound bite a second ago. I don't know why he did it But this is him saying he was coming up with a name for newly convicted Carmelo Anthony Let me make one up. How's that one strike y I hope he enjoyed his first night in a cell last night becauseuse he's going to have many nights to think about what He did H's an angry dad who is now unfortunately succumbing to Mbe a lot of what he's been listening to around him as there is this huge divide in that community, and he has chosen a dark path. He just has. He's leaned into it. It feels good right now, maybe evenven him kind of saying, I'll make up a racist
